Washington and Nevada require that we have a Consumer Health Data Privacy Policy under certain health privacy laws. This is that policy, and describes Pacira BioSciences, Inc.’s collection and use practices for “consumer health data” collected from Washington and Nevada residents. This policy applies only in the narrow circumstances where we are collecting and processing consumer health data as that term is defined under Washington and Nevada law. For example, this includes personal information linked to you that identifies your physical or mental health status. In this policy we refer to this information as “CHD.”
This policy does not apply to our general privacy practices. This policy does not apply to any “protected health information” or information that has been de-identified. Our collection and use of information in connection with clinical trials or other health-related research is also not covered by this Policy. It is described in the consent forms and/or other notices provided for those purposes. This policy also does not apply to information we collect from employees or contractors. This policy is incorporated into our Terms of Use.
The type of CHD we collect depends on your relationship with us. It also depends on how you interact with us. For example, CHD we might collect includes:
We use CHD to provide support and services reasonably expected and requested by you. This may include reviewing your ability to access or use certain products and services. It also is used to investigate reports submitted about our products. We also use CHD as permitted by your consent. We use CHD to fulfill our legal obligations and as otherwise permitted by law.
Additionally, we may deidentify CHD so that it cannot reasonably be reidentified by us or by another person. We may use this deidentified data for any reason permitted by applicable law. If we deidentify information that was originally based on CHD we maintain and use that information in deidentified form and will not attempt to reidentify the data, except as otherwise permitted under applicable law.
Our sources of CHD depends on your relationship with us. In many situations, we collect CHD directly from you. For example, we collect CHD when you tell us about a medical reaction you may have had to one of our products. We also collect CHD if you sign up to participate in any of our patient-related programs. We collect CHD if you sign up for webinars or other events. We also collect CHD if you otherwise submit it to us.
We may also get CHD from third parties. For example, from your healthcare providers including specialty pharmacies and/or labs or testing facilities. We may also get information from health insurance companies and payors. Your authorized legal representatives and caregivers may provide us with information about you. Vendors who provide us with data analytics and market research services may provide us with CHD about you. As permitted by law, these third parties may share certain CHD about you with us.
We may share CHD for purposes permitted by law. This includes sharing with vendors that provide services to us for the purpose for which the CHD was collected. It includes sharing CHD with regulators or government agencies as required by reporting obligations under law. This also includes sharing CHD with any current affiliates and subsidiaries and any successor to our business, such as part of a merger, acquisition or bankruptcy, etc. Under Washington and Nevada law we are not required to obtain your consent for sharing in these circumstances.
Under Washington and Nevada law you have certain rights. Those rights depend on our relationship. They are subject to certain limitations and are not absolute.
